1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the StartEase website (https://www.startease.app), including the ETI assessment, results, reports, the Training Hub and training programs, games, and related content and services (collectively, the "Service"), provided by VentureEase Academy ("we", "us", "our").

By accessing or using the Service, you signify your agreement to be bound by these Terms and our Privacy Notice. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

The ETI is a psychometric assessment designed to provide insights into entrepreneurial styles, attributes, and potential readiness. The Service includes the online assessment, calculation of results (including subtypes, disciplines, leans, tensions, ideal partners, etc.), display of concise and potentially comprehensive reports (for Pro users), training programs with accompanying workbook materials, interactive games (Guess Who? and Business Boo, with a waitlist for the Fantasy League), achievement badges, leaderboards, and features for saving progress and results history (for registered users).

3. Accounts and Registration

  • Registration: To save results and access certain features (like history, Pro benefits, Training, persistent game scores, and badges), you must register for an account by providing your name and a valid email address and creating a password.
  • Accuracy: You agree to provide accurate, current, and complete information during registration and to update it as necessary in Settings → Profile.
  • Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  • Preferences: You are responsible for managing your account preferences, such as your cookie consent and your consent for sharing your email address with marketing affiliates or for testimonial use, in Settings.
  • Display Name: The first name on your account may be publicly visible on leaderboards if you achieve a ranking in games. You can update it at any time in Settings → Profile.
  • Eligibility: You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account.

4. Use of the Service

  • Permitted Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, or internal business use related to understanding your own or your team's entrepreneurial profile (subject to any applicable plan limitations).
  • Prohibited Conduct: You agree not to:
    • Use the Service for any unlawful purpose or in violation of these Terms.
    • Attempt to interfere with, disrupt, or compromise the security or integrity of the Service or its systems.
    • Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying algorithms of the ETI assessment or Service.
    • Scrape, data mine, or systematically extract content or data from the Service.
    • Share your account credentials or allow others to access your account.
    • Resell, sublicense, or commercially exploit the Service or its results without our express written permission.
    • Remove or obscure any proprietary notices.
    • Manipulate game scores, leaderboards, or badge progress through automated means, multiple accounts, or other fraudulent methods.
    • Use offensive, misleading, or inappropriate names on leaderboards.

5. Pro, Training, and Payments

  • Paid Features: We offer enhanced features (Pro) and training programs through one-time purchases.
  • Payment: Payments are processed through third-party providers (e.g., PayPal). By purchasing, you agree to the terms and conditions of the relevant payment processor.
  • Fees: All fees are stated in USD unless otherwise specified and are non-refundable once access is granted, except as required by law or explicitly stated at the time of purchase. A training registration you cancel before the program starts is refunded in full.
  • Access: Access to paid features is contingent upon successful payment and adherence to these Terms.

6. Intellectual Property

The Service, including the ETI assessment methodology, questions, algorithms, scoring logic, reports, the StartEase Framework, text, graphics, logos, and software, is the property of VentureEase Academy or its licensors and is protected by copyright, trademark, and other intellectual property laws. Your use of the Service does not grant you any ownership rights.

7. User Comments and Content

Signed-in members can comment on training articles. You are solely responsible for the content of your comments. You agree not to post content that is illegal, abusive, defamatory, harassing, or violates the rights of others. We reserve the right to remove any comments at our discretion without notice. By posting, you grant us a non-exclusive, royalty-free license to display your comments on the Service.

8. Feedback and Testimonials

If you provide feedback, suggestions, or testimonials, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such feedback for any purpose, including improving the Service and marketing.

We publish your comment as a testimonial on our About page only if you consent to it in the survey that follows your results, and only after our team approves it. A published testimonial shows your first name, role and industry, which you must provide to give this consent, and a link to your website or social profile if you provide one. If you provide specific consent to use your name or other identifying information with a testimonial, we will use it only as consented.

You may manage your consent for testimonial use in Settings, under Testimonial Preferences. Withdrawing it removes your testimonials from the About page. Deleting your account deletes your feedback and testimonials.

9. Game Mode and Leaderboards

  • Games: The Service includes interactive games such as "Guess Who? - ETI Edition" and "Do You Know Your Business Boo?", and a waitlist for "The ETI Fantasy League." These games are provided for entertainment and educational purposes.
  • Scores and Rankings: Game scores and statistics are tracked and may appear on public leaderboards. By playing games while logged in, you consent to your first name and scores being publicly visible.
  • Anonymous Play: You may play games without logging in. Anonymous players are identified by a randomly generated ID and appear on leaderboards as "Player_" followed by a six-character code derived from that ID, never the ID itself.
  • Business Boo Predictions: When you invite someone to Business Boo, we email them an invitation with your first name. When they complete the assessment through your link, their subtype is shared with you. If you complete the assessment through an invitation you received, your subtype is shared with the person who invited you. Invitation links are unique and should only be shared with your intended recipient.
  • Fair Play: We reserve the right to remove scores, reset leaderboards, revoke badges, or suspend accounts that we determine have violated fair play principles or manipulated results.
  • No Prizes: Games are for entertainment only. Unless explicitly stated otherwise in a specific promotion, there are no monetary prizes or rewards associated with game performance.

10. Badges and Achievements

  • Earning Badges: Badges are awarded automatically when you meet specific criteria (e.g., completing assessments, winning games, maintaining login streaks). Badge criteria may change at any time.
  • No Monetary Value: Badges are virtual achievements with no monetary value and cannot be transferred, sold, or exchanged.
  • Revocation: We reserve the right to revoke badges that were earned through fraudulent means or system errors.
  • Display: Badges you earn are visible in your Dashboard and may be visible to administrators of your portal (if applicable).

11. Disclaimers

  • No Professional Advice: The ETI assessment and results are provided for informational and educational purposes only. They do not constitute psychological, career, financial, legal, or any other type of professional advice. You should consult with qualified professionals for specific advice tailored to your situation.
  • "As Is" Basis: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • Results Interpretation: While based on psychometric principles, ETI results are interpretations and should be considered as one tool among others for self-understanding. Individual experiences and outcomes may vary.
  • Game Results: Game outcomes and leaderboard rankings are for entertainment purposes only and do not reflect any professional assessment of your entrepreneurial abilities.

12. Limitation of Liability

To the fullest extent permitted by applicable law, VentureEase Academy, its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content, even if we have been advised of the possibility of such damages. In no event shall our aggregate liability exceed the amount you paid us, if any, in the past six months for the services giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless VentureEase Academy and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You can delete your account at any time in Settings.

15. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Alachua County, Florida to resolve any dispute or claim arising from these Terms or the Service.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect by updating the "Last updated" date. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
